Mediation
Mediation includes any type of dispute between two parties that might be settled by compromise with the help of a skilled professional mediator. Ms. Mann has a rich background of experience and training in mediation. In law school, she worked with Utah Dispute Resolution as a mediator and mediation administrator. She is a member of the Utah Council on Conflict Resolution, the professional mediator's association, and conducts frequent divorce mediations.
All Utah divorces must go through divorce mediation before they go to trial. The courts believe that many issues can be resolved through mediation, which is less expensive to the parties and keeps the courts free for other matters.
Ms. Mann participates in divorce mediation in a number of ways.
As an Independent Mediator
If the husband and wife believe that their disputed issues are likely to be solved by mediation, they can hire Ms. Mann together to serve an independent mediator.
If the issues are resolved in mediation, Ms. Mann can then act as the attorney for both parties, drafting the divorce decree and other documents. She then supervises their journey through the legal process with the courts until a judge signs the decree and finalizes the divorce.
If the issues are not resolved in mediation, the parties will each have to hire their own attorney to proceed with the divorce. In that case, Ms. Mann cannot represent either party, as the mediation process has made her privy to private information from both sides.
In either case, the two parties each pay half the fee.
As the Attorney for One Party to the Mediation
If you do not believe that the issues can be resolved in mediation, then you can hire Ms. Mann to represent you. In many mediations, particularly those that are complex or contentious, it is advisable to have your attorney attend the mediation sessions. Then, following the mediation, Ms. Mann can carry forward the process of divorce as your attorney.
